At its May 25, 2006 hearing, the Commission on State Mandates found that the Mandate Reimbursement Process (MRP) claim does not impose reimbursable state-mandated activities upon local government and school districts.  The legislature introduced AB 138 in 2005 which included language directing the Commission on State Mandates to reconsider any previously determined mandates that are deemed "reasonably necessary" or "reasonably within the scope" of a ballot measure and therefore not reimbursable.   Your need to prepare mandate reimbursement claims was determined to be "reasonably necessary" to implement Proposition 4, the original ballot measure that added the right to state mandate reimbursement in the first place.

On the bright side, the mandate consultants are more competitive than ever with their fees to prepare your claims.   Our initial research indicates that consultant fees are down for the 2004/2005 fiscal year (costs to prepare district's 2003/2004 claims) by an average of 15 percent or more already!
